Abstract

This study AIMS in its entirety to reach the scientific understanding of the social representations of legal actors towards criminal policy (criminal code), So That they Can benefit from them in the scientific and practical fileds; any disclosure of the imperial reality of criminal law or penal law lt is also called in Algeria; it is based on the well-known legal rule neither crime nor punishment except in legal text , we have seen in the Ethnomethodology current from the most appropriate sociological inputs in depicting the most objective reality of this study and in its comprehensive and more. The latter has produced a series of result the most important of which is the results:

There is a consensus among the legal actors (gudicial officers) that there is legal disfairness resulting from the act (about what law I am talking about we live in a play with a life no law; no justice… There was no law …the law applied to the meridian …imprisonment for the men of our master Yusuf and imprisonment…)the rich are less likely to be punished in the answers of the respondents in exchange for the same action among the respondentes in exchage for the same action among the legal actor as an observer and social facts,it is govered by a specific cultural reference judging things and behaviors and their knowledge can only Be through what the individual holds from a refernce culture ;and we ;as researchers ;have tried to discover africa by extrapolating the social reality ,revealing the hidden side,and reaching the scientific knowledge That the actors produce towards the Law to access the daily life of actors in the judicial system
