Abstract

The issue of custody is one of the an effects of divorce and its special issues and provisions, in particular the new amendments to the articles of the Algerian Family Code under Ordinance No. 20-05, is an area of jurisprudential difference, but it does not depart from the general principles and rules of Islamic law. There is a difference in the method of adaptation and application of certain particles.
