Abstract

Protecting employee privacy in the workplace raises several issues, the fundamental problem being the difficulty of reconciling the employer's right to exercise their powers with the employee's right to privacy. During the contractual relationship, an employee's privacy can be threatened by their professional life due to their subordination to the employer's authority. This can significantly restrict the worker's freedoms, as the employer may impose control or surveillance within the company, using electronic means. For this reason, the legislature has recognized the right of workers to protect and exercise their right to privacy, even during working hours and at the workplace. The employer is prohibited from intervening unless justified in maintaining the legitimate interests of the establishment.
