The Constitutional Council's Oversight of the Validity of Presidential Elections in Algeria Through the 2016 Constitutional Amendment

The Algerian Constitutional Council ensures the regularity and validity of the election of the President of the Republic. This competence is conferred upon it by the Constitution and is governed by Organic Law No. 16-10 relating to the electoral system, as well as by the rules governing the functioning of the Constitutional Council. Accordingly, it oversees the filing of declarations of candidacy submitted by candidates to the General Secretariat of the Constitutional Council and adjudicates upon them. It also examines and rules on appeals lodged by candidates concerning the provisional results of the presidential election. Furthermore, the Constitutional Council exercises oversight over the accounts of electoral campaigns and their methods of financing. It should be noted that decisions issued by the Constitutional Council in this المجال are not subject to any form of review and cannot be challenged, pursuant to Article 191 of the Algerian Constitution of 1996, as amended and supplemented.
