The Importance of Forensic Medicine and its Impact on the Conviction of the Criminal Judge
Keywords:
Forensic Medicine, Criminal Evidence, Criminal Judge, Personal Conviction, Medical ReportAbstract
This study aims to demonstrate the importance of forensic medicine as a pivotal tool in the criminal evidence system, employing a descriptive-analytical approach to clarify legal and medical concepts and their role in solving crimes. The research concludes that forensic medical reports constitute a scientific foundation that assists the judge in accurately determining the material elements of a crime and attributing it to the perpetrator, thus minimizing the potential for judicial error. Despite their definitive scientific nature, the findings reveal that the Algerian legislator has subjected these reports to the judge's discretionary power, based on the principle of personal conviction.
