Abstract

Partnership contracts are among the most important administrative
contracts That reflect the participation of the private sector in public sector
projects and the developement of public facility services. The laws regulating
partnership contracts grant the administration several execeptional authorities
through these contrats , under the umbrella of achieving the public interest . These authorities include the autority to supervise and direct the activities of the private partner , the autority to amend contract and the autority to impose penalities on the private partner in case of non-compliance with contractual obligations.
However, these authorities are not absolute; they are limited by a set of
rules to prevent the administration forme abusing them and infringin on the rights
of the private partner
