Procedural provisions of the immediate appearance system in Algerian legislation

Abstract

The Algerian legislator, similar to contemporary legislation, introduced the system of immediate appearance through Order 15-02, so that this procedure is one of the alternatives to the public lawsuit that strengthens the right to defense and the presumption of innocence, thus becoming an important turning point in the penal policy of the Algerian legislator, as we aim through this study to Identify the procedural provisions for immediate appearance by reviewing the applied procedures for the immediate appearance system. The immediate appearance is considered one of the procedures for initiating a public lawsuit in the case of a flagrante delicto that does not require a judicial investigation, and this is through the procedures specific to this system and stipulated by law. All these steps are carried out in compliance with a set of exceptional procedures and guarantees that the Algerian legislator has introduced in line with Contemporary criminal policies within Order No. 15-02.
