Abstract

Each country seeks to improve the living conditions of its inhabitants by improving the public service throughout construction of public facilities but its limited financial resources and lack of modern technology to realize public facilities of high quality Imply conclusion of so called partnership contracts between public and private sector in order to realize projects of infrastructure in which the private partner supplies the service object of partnership between public and private sector and in this context the will of the state and the private partner aims at creating a direct right to the public of beneficiaries, this last, who is not a part in the partnership contract but the enrollment in favor of others has visible impacts in the three relations : between the state, the private partner and the public of beneficiaries which take the form of reciprocal obligations and rights.
