Conflict of jurisdiction in Algerian military justice

Abstract

According to the Algerian legislator, military justice has jurisdiction over public actions relating to military crimes and all offenses that threaten state security. The jurisdiction of military justice is characterized by a specific concept and nature, and it takes three forms: territorial, subject-matter, and personal. This situation creates conflicts and overlaps between military courts themselves as well as between military and criminal courts. Such overlap and conflict may lead at times to positive results and at other times to negative ones. Accordingly, it is necessary to reach appropriate solutions to the issues arising from this jurisdictional conflict in order to achieve, or at least come as close as possible to achieving, justice.
