Abstract

 Jurisdiction is among the main conditions that make implementing foreign judicial judgement possible. Likewise, they are considered to be among the most complex and debatable issues, given the problematics it arises. Most internal legal texts and international agreements have convened that its control is of utmost importance in order for a foreign judgement to be implemented under national law. Despite the unison that it was intended as a requirement of international jurisdiction, there remains a disagreement over determining the law to refer to, when the judge who is required to issue an executive order that determines jurisdiction, When referring to the Algerian legislator, we find that they adopted this condition in the Civil and Administrative Procedures Law 09/08, however, left vague about its organization, which consequently neglected the matter of dealing with the international agreements concluded by Algeria on judicial and legal cooperation.
