الملخص

تتناول هذه الدراسة دور المشرّع الجزائري في التصدي لجريمتي التمييز وخطاب الكراهية، اللتين شهدتا ارتفاعاً ملحوظاً في الآونة الأخيرة داخل المجتمع الجزائري. وقد بادر المشرّع إلى سنّ القانون رقم 20-05، الذي يتضمن تعريفاً دقيقاً لجريمتي التمييز وخطاب الكراهية، بالإضافة إلى استحداث مجموعة من الآليات لمكافحتهما. ويتبنى القانون نهجاً شاملاً قائماً على جانبين: جانب وقائي يشمل تنظيم حملات توعية وتثقيف لتعزيز ثقافة التسامح ونبذ الكراهية، وجانب عقابي يشمل عقوبات أصلية وتكميلية تهدف إلى الحد من ارتكاب هذه الأفعال ومعاقبة مرتكبيها.
