The individual complaint mechanism of the Human Rights Committee provides an important pathway for victims across the globe to seek justice through the international system. Operating under the First Optional Protocol to the International Covenant on Civil and Political Rights since 1976, it has developed substantial jurisprudence that carefully protects human rights while respecting state sovereignty. The mechanism requires strict procedural compliance, including exhaustion of domestic remedies and adherence to jurisdictional requirements. The framework addresses critical jurisdictional questions, including temporal, territorial, substantive, and personal jurisdiction.
The mechanism produces meaningful outcomes through interim measures and reasoned determinations called "Views" that, while not formally binding, carry significant moral and legal weight. These Views gain credibility through voluntary state compliance, demonstrating commitment to human rights obligations.
