The right to run for the presidency of the republic in the electoral system in Algeria

Abstract

 In the Algerian political system since independence, the President of the Republic occupies great importance, a pivotal position, and a special position that transcends all centers and positions in the state, according to the lofty status of his status, his constitutional position, and the deriving of his legitimacy directly from the sovereign people. He is considered the first political figure at the top of the pyramid of power, enjoying greater powers than all traditional authorities ( legislative and judicial) in the country. Due to the seriousness of the tasks entrusted to the President of the Republic, the right to run for this position in the electoral system in Algeria was surrounded by a set of objective restrictions and conditions. Since independence, the Constitutional Founder alone has ensured that they are put in place to prevent the exercise of this right by certain groups. This inherent and exclusive jurisdiction has not been ceded to the legislator except with regard to procedural conditions. For the elections of the President of the Republic Despite this, there were some violations of jurisdiction by the legislator by stipulating some restrictions that prevent some citizens from running for the presidency of the republic, which the Constitutional Council addressed at the time since its establishment under the 1989 Constitution.
