The Role of the Judiciary In Activating The Mechanism of the Exception of the Unconstitutionality- The Right to Appeal in Penal Matters as a Mode

Abstract

The algerian legislator's acknowledgment the right of the exception of unconstitutionality of laws for persons, under the constitutional amendment of 2016 and Organic Law No. 18-16 of September 2, 2018 defining the conditions and modalities of the application of the exception of unconstitutionality, Is an important step to enhance their role in protecting their rights and freedoms as stipulated by the Constitution, and to strengthen the role of the judiciary and the Constitutional Council in purifying our legal system of unconstitutional requirements. In this study, a model was chosen from the penal field, which could be used for the application of the mechanism of the exception of unconstitutionality and to examin the role that can be played by the penal judiciary to activate this exception, by addressing the conditions of a the conditions of accepting the exception of unconstitutionality in the algerian law, and how to deal with it in front of the judicial authorities, and exercising the right to challenge the appeal of penal matters as a model for the promotion of the exception of unconstitutionality in algeria. Résumé: L’approbation par le législateur algérien du droit à l’exception d’inconstitutionnalité pour les personnes, conformément à l’amandement constitutionnel de 2016 et à la loi organique n°18-16 du 2 septembre 2018, fixant les conditions et les modalités de mise en oeuvre de l’exception d’inconstitutionnalité, est un pas important pour renforcer leur rôle dans la protection de leur droits et libertés, et renforcer le rôle des instances judiciaire et le conseil constitutionnel dans la purification de notre système juridique d’exigences inconstitutionnelles. Dans cette étude, un modèle à été choisi dans le domaine pénal, qui pourrait être utilisé pour mettre en oeuvre le mécanisme d’exception d’inconstitutionnalité, et recherché le rôle que pourrai jouer les juridictions pénal pour l’activer, en abordant les conditions d’acceptation de l’exception d’inconstitutionnalité en droit algérien, voir la manière de le traiter devant les instances judiciaire, et l’exercice du droit d’appel en matières pénal comme modèle de l’exception d’inconstitutionnalité en Algérie.
