Abstract

The European court of human rights played an important role through the granted to it in the field of archiving judicial protection of the rights power recog- nized by the European convention human rights as well as the protocols related it, considering that environmental protection as field carries a legal character, especially after the establishment of the right to living and sustainable environment in light of the resolution of the human rights in 2021it has become necessary explicitly acknowledge this right as al a legal basis than enables litigants at the Strasbourg court level to cling to it as a direct legal argument in order to ensure the protection of right, and as a supporter environmental issues at the European level.
