The Theory of Administrative Organization in Algeria: the Principle of Presidential Authority Between Text and Practice

In this paper we examine the problem of applying the principle of presidential authority in the Algerian administrative organization, especially the idea of combining administrative centralization with decentralization. It also discusses the importance of a strong and effective presidential authority in practice. Presidential authority has a major role in contributing to the achievement of sustainable development and governance. To analyze this problem and answer it, we have adopted a knowledge approach that combines the legal and political approach beginning with defining the concepts of administrative organization and the principle of presidential authority. Indeed. he question of following the state to the pattern of horizontal power has posed a threat to the unity of the country and the people. Therefore, the choice of vertical power at that stage was the best solution, especially for some peoples and communities, so that the security and integrity of its territorial integrity and territorial borders would be preserved. Where the unity of all parties and movements and dissolved in the crucible of one party and one army and one leadership, so as not to multiply opinions and diverge the word, which we will try to clarify through the issue of presidential power, which raises the issue of renewed: How can the theory of presidential power contribute to the power of the central and decentralized administrative organization? The main findings of the study are: The presidential power based on the law represents the protective shield of the nation, as it is credited with preserving and strengthening all state institutions and protecting them from the danger of division and dispersal. Algerian law gives a broad margin to the presidential authority in the implementation of the decisions and laws of the state, but remains the desired goal and the highest is to establish legitimacy and uphold the rule of law on all authorities. The existence of some illegal practices such as abuse of presidential power, but treatment remains the best solution to return to the right path. The necessity of thinking about applying the rule of combining centralization and decentralization, which has become more than necessary due to the many problems and complexities encountered in decentralized applications, and filling all gaps, especially the issue of the danger of reviving regional, ethnic, tribal and other strife.
