Abstract

Anyone examining the reality of endowments (waqf) in Algeria will find that, more than three decades after the issuance of Law 91-10 concerning endowments, as amended and supplemented, the legal frame work for managing and administering endowments has failed to achieve its lofty goals. Practical experience has demonstrated its limitations over the years, regardless of any positive results achieved, the least of which is the restoration of the status of endowed properties. From this perspective, this research paper focuses on a preliminary reading of the new endowments law issued in 2025, concentrating on the substantive aspects to discuss and analyze the most important features of its new provisions and compare them with other legislation that has addressed or regulated endowments, such as the Family Code. The paper also considers the procedural aspects, which emerged within the context of the new vision adopted by the Algerian legislator, leading to a revision of the law. Comprehensive of the previous law 91-10, within the comprehensive strategy of the state that aims to keep pace with the approach witnessed by many legislations in the Islamic world and others, which have witnessed a qualitative leap in developing and upgrading endowment legislations, through developing its practical applications in many countries, including Western countries, even if this is with other names and methods that are appropriate to their local legal systems and their intellectual and Her beliefs.
