Abstract

 Studying the legal system of the National Center for Commercial Registration is of great importance for many reasons. Considering it as an independent administrative institution on the one hand and a merchant in its relations with others on the other hand raises several problems regarding its legal nature, and as a result, the search for determining the judicial authority competent to consider and resolve its disputes. If it is included among the public institutions of an administrative nature, then the disputes in which it is a party will fall within the jurisdiction of the administrative judiciary. If it is considered a public institution of an industrial and commercial nature, then its disputes will be subject to two judicial authorities: they will be subject to the jurisdiction of the ordinary (commercial) judge in his relations with others and to the jurisdiction of the administrative judge when he uses the privileges of public authority.
