Guarantees for the protection of victims of enforced disappearance During armed conflicts

Abstract

The enforced disappearance of persons during armed conflicts, is a crime against humanity and a gross violation of their freedoms, the source of its criminalization is due the customary and written rules of international humanitarian law, which established guarantees of protection before the crime was committed, through the commitment of the parties to the armed conflict to prevent its commission and criminalize them, and guarantees when they are committed that those responsible will be brought to court, regardless of their responsibilities, and not with impunity, and compensate the victims for the damage. However, the materialization of these guarantees depends on international mechanisms that enforce their commitment and non violation, through the prevention, monitoring and alerting role of international organizations, and the punishment role played by the international criminal court.
